No plans yet to get involved in formation of AOA: UP-RERA
NOIDA: With Covid cases rising, the UP-Rera will now defer some of its initiatives, including their plan to get involved in the formation of the apartment owners’ association (AOA) of individual apartments where residents have moved in.
The UP-Rera had earlier announced that they would get involved in the process of creation of AOA to dilute conflict between builders and buyers as in many cases buyers complain about the builder’s resistance in handing over maintenance control.
Balvinder Kumar, of UP-Rera, said, “This is not our priority at the moment given the current pandemic situation.”
Pushkar Chandra, a resident of Sector 62, said, “There are around 200 builders’ societies in Noida that have not formed AOA and are not handing over to Registered AOAs as transfer of funds is involved in the process. Why is the government not forcing their formation?”
Builders, however, said that they don’t have clarity whether UP-Rera laws should prevail in the creation of AOAs of the UP Apartment Act, which already has a provision for the same.
RK Arora, president Naredco of UP, said, “Formation and maintenance of RWA is governed by two different legislations. One is Rera Act, 2016 and the other is UP Apartment (Promotion of Construction, Ownership & Maintenance) Act, 2010. Both have ambiguities as to the scope and areas of operations. It would be better if the government clarifies these points.”
