Haryana RERA sends notice to JMD Developers as it fails to form allottees’ association

GURUGRAM: Acting on the complaints of investors of JMD Suburbio, the Haryana Real Estate Regulatory Authority (HRera) has issued a notice to the developer of the commercial project in Sector 67, asking it to state reason why a daily penalty of Rs 1 lakh should not be imposed for its failure to form an association of allottees.

H-Rera has also asked the department of town and country planning (DTCP) to initiate legal proceedings against JMD developers for selling commercial spaces in the project just by buying floor space index (FSI) from licencees, Anand Dham Realtors and Ansal Properties, and also failing to register the project with the regulatory authority.

In fact, the show-cause notice was issued to JMD developers on October 6, after the regulatory authority observed that the real estate firm had failed to make any efforts in forming an association of allottees even after three years of H-RERA Act coming into force. Spread across four acres, Suburbio was launched in 2007.

“These proceedings be taken as show-cause notice also as to why a penalty of Rs 1 lakh daily be not imposed if the association of allottees is not formed within a month…,” read the proceedings.

H-Rera, in its proceedings, also observed that though JMD developers was neither the licencee nor the collaborator, by purchasing FSI, it had entered into a builder-buyer agreement. Also, JMD didn’t take the benefit of business incentive policy (BIP) that was launched by the state government in 2015, to regularise such kind of irregularities.

When contacted, the spokesperson for the developer said that the company has already submitted its reply and clarification to the regulatory authority that JMD has complied with all the rules and regulations, including obtaining benefits of BIP.
