Haryana RERA restrains Mahira Group from cancelling allotment over dues
GURUGRAM: The Haryana Real Estate Regulatory Authority (H-Rera) has restrained
the Mahira Group from cancelling any unit of the allottees in its affordable housing project in
Sector 63A over non-payment of any dues.
The regulator’s order comes in the wake of a plea by the investors who claimed to have already
paid 50% of the project cost “whereas there has been just 5% construction at the site”.
The developer, the allottees alleged, had threatened to cancel the allotment of units for nonpayment of a monetary demand raised by the Group in the first week of January.
In its order on Thursday, the regulator invoked Section 36 of the Rera Act to restrain the builder
from cancelling any unit in the project till the next date of hearing.
“The developer is further directed not to create third party rights till the pendency of the present
complaint. Further, the application received from the allottees be forwarded to the promoter for
filing the reply within two weeks” the order read.
In fact, in its September 2022 order also, the Rera had restrained the builder from cancelling
any unit on account of non-payment of the instalments due as per the original payment plan.
“We appreciate the Rera’s order but it gave just another date to the buyers. We need a
construction-linked plan for payment and regular monitoring of the project,” one of the allottees
said.
A spokesperson for the builder said, “The company is raising demand as per the norms, and the
project will be completed as per the commitment and funds are needed for the same.”
