Haryana-RERA resolved only 50% plaints in five years; buyers say ‘too slow’
GURUGRAM: In the last five years, the Haryana Real Estate Regulatory Authority (HRera) has
resolved only around 53% of complaints it received from aggrieved homebuyers, while the rest
are at various stages. Homebuyers have claimed that resolution of complaints before HRera
was too slow, forcing many to approach other authorities for justice.
Data shared by HRera shows a total of 26,356 complaints were submitted before HRera since
February 2018. Of these, only 13,133 complaints that were submitted at the authority’s office
were taken into consideration since the regulator made submission of physical copies of
complaints a must.
Of these 13,133 complaints, the authority has decided on 7,031 complainants so far, while
around 6,102 are pending before it. Of the pending complaints, 4,747 are pending before the
court, of these first hearing has been held in only 981 cases. The rest are at various stages:
scrutiny, reply or reserved by the authority.
According to HRera officials, the volume of complaints has gone up with the increased
awareness among homebuyers. Ban on proceedings related to refund cases for the past over
one year and pandemic-related hindrances also led to a backlog, an official said.
Meanwhile, several initiatives have been taken by the authority to ensure fair and quick
redressal of the problems faced by homebuyers and developers. The authority had also set up a
digital court to speed up the disposal of complaints.
However, the nearly 50% pendency of complaints before HRera has forced homebuyers to
approach other platforms to seek justice.
“The complaints before HRera are moving very slowly. It gives developers time to manage
irregularities and aggrieved homebuyers are left with no option but to approach other
authorities,” said Vikram Singh, who invested in an affordable housing project in Sector 62 six
years back but is still waiting for possession.
A city-based lawyer, meanwhile, told TOI that the authority should not take more than 60 days to
decide on a complaint as per the norms but it usually takes four to six months and sometimes,
even more, to dispose of a complaint.
