Gurugram: Farmers get plots after years of legal battle, find they are up for auction

GURUGRAM: After years of legal battle, the farmers, whose land was acquired by HSVP (formerly Huda) to develop different sectors of Gurgaon, were allotted a certain number of plots. But before offering physical possession of the plots to the farmers, the development authority has listed the same for auction. The farmers allege that HSVP is denying the rights of the oustees.

In fact, between 1981 and 2000, HSVP acquired hundreds of acres from around 1,500 farmers of Mullahera, Katarpuri, Gurgaon village, Dundahera, Chauma, Basai and Dhankot villages to develop sectors 4, 5, 6, 9, 10, 22 and 23 of Gurgaon.

Farmers got compensation for their land and assurance of a plot in a sector developed on their land.

On the direction of the Punjab and Haryana HC, HSVP formed an oustees policy in 2013 that was amended in 2018, under which the ousted famers could apply for plots that would be allotted through a draw at market price. In September 2018, out of 294 applications filed with HSVP’s estate office-1, some 38 were found eligible. Of another 622 applications filed with estate office-2, some 116 were found eligible.

Subsequently, HSVP reserved 370 plots under estate office-1 and 38 farmers were allotted plots through a draw of lots. Of these 370 reserved plots, HSVP has already auctioned 66 plots. And now it has listed for auction the plots — numbers 208, 209, 1030 and 1032 in Sector 9A, numbers 1089, 1090, 1091 and 1092 in Sector 22, and numbers 1261 and 1262 in Sector 23 — that have already been allotted to the oustees.

“This is in gross violation of HSVP’s policy and guidelines. It is defying the judgments of the high court,” said Omprakash (78), who was allotted plot number 1092 in Sector 22. This plot is now up for auction.

Similarly, Sube Singh Yadav (60), who was allotted plot number 1091 in Sector 22, demanded the immediate cancellation of the e-auction of plots reserved under the oustees quota. “We have been fighting legal battles for years but despite repeated court orders in our favour, we have not been able to get the plots,” he said.

When contacted, a senior HSVP official said, “We have formed a policy for allotment of plots to oustees and a certain number of plots have been reserved under this category. The plots which were allotted to 38 oustees are under scrutiny.”
