DTCP bans registry and sale of properties in Palam Vihar
GURUGRAM: The department of town and country planning (DTCP) has banned registration of properties and execution of sale deeds in Palam Vihar over non-payment of external development charges (EDC) and internal development charges (IDC) and non-renewal of licence.
The residents, who are facing a tough time due to DTCP action, have demanded that restrictions be imposed on properties owned by the developer and not them.
On August 26, DTCP had banned purchase and sale of properties in 18 residential societies, including Palam Vihar, over violations of licence norms and non-payment of dues such as EDC.
Gurgaon home developers and plot holders’ association president Narendra Yadav met the town and country planning officials seeking relief as it was provided to Sushant Lok residents earlier. “Residents are facing a tough time due to non-payment of dues by the developer. It is unfair and action by DTCP is causing inconvenience to residents who have paid cost to the developer and all dues to the authorities,” he said.
A resident said, “It seems there is some miscommunication from the authorities’ end. The revenue department should be conveyed by DTCP that restrictions are imposed only on developer-owned properties and not a third party.” He said the tehsildars, soon after the DTCP order, have stopped executing sale deeds on properties.
Yadav, who handed over a memorandum to district town planner (enforcement) Amit Madholia, further said similar action was taken in Sushant Lok-2 last month, but later the department clarified that order is applicable only on the developer’s properties.
Madholia, when contacted, said he has received the memorandum from the association and the matter has been discussed with senior officials and a clarification will soon be issued.
Meanwhile, a drive was conducted to seal extra flats constructed by builders on all floors in the C-2 block of Palam Vihar, in the presence of police. The action was taken as the offenders started construction in 16 flats sealed by DTCP. The department has already filed a complaint seeking an FIR against the violators.
Also, the developers of these units have not deposited the outstanding dues, including EDC. They have failed to adhere to the terms and conditions of the licence and the agreement. Moreover, the licence of many of these societies has not been renewed after expiry,” said Madholia.
Another DTCP official said the department could have easily sealed these properties. “But as many properties were occupied, we just imposed a ban on the registration of sale deeds. In almost all cases, the developers have knowingly ignored the terms and conditions of the licence.”
