Gurugram: Told to vacate alternative flats in one week, say Chintels Paradiso residents

GURUGRAM : Several homeowners of Chintels Paradiso, who have not opted for settlement after defects were found in
the buildings they lived in, have alleged that they fear eviction as the developer has told them to vacate
their alternative accommodation in seven days.
At least 10 flatowners of towers D, E and F at the Sector 109 society told TOI on Tuesday that the
developer sent them e-mails on June 11, saying that it is terminating their rental contracts and the families
must vacate the accommodations in a week.
The developer said it has not sent any “eviction notice”.
The flats in question are alternative accommodations that were provided after homeowners had to vacate
their own flats in the aftermath of a vertical collapse at Tower D of the society.

Inspections of the tower by experts from IIT-Delhi after the February 2022 cave-in had found irreparable
structural defects in the tower. Subsequently, defects were found at two more towers – E and F –
prompting the residents to vacate those too.
Vikram Gambhir, who owned and lived in flat number 202 at Tower D, was given alternative
accommodation at another flat in Tower C of the society by the developer, Chintels India.
He said he got the developer’s e-mail last Sunday. It said that since the buyback option has not been
chosen, your “license/lease stands terminated. CIPL requests you to kindly vacate the flat…within 7 days
from receipt of this email/notice”.

“How is this justified? I am a senior citizen with no fixed income, and I suffer from multiple ailments. It
is not possible for me to vacate the temporary accommodation. It seems like the notice has been issued
with malicious intent,” Gambhir said.
Last month, Chintels India agreed to two options – pay the cost of the flat to homeowners of towers D, E
and F at Rs 6,500/sqft within four months and refund stamp duty along with the cost of interior work at
the house; or renovate/rebuild the buildings according to expert recommendation.
When asked about the e-mails, a spokesperson for the developer said: “In the case of the second option,
we will charge (homeowners) Rs 1,000 per square foot for material cost increase, and we will not pay rent
(for alternative accommodation). We have not issued any eviction notice.”
According to the society’s RWA, 180 families were relocated from the three towers. An estimated half of
them have opted for the compensation offer till now, but many are undecided.
Deputy commissioner Nishant Yadav, when asked about the developer’s e-mails, said the issue has been
brought to his notice.
“Till the final settlement is not done, the developer has to pay the rent and a direction for the same has
been given already.”
Vacate tower G, district admin tells residents
Separately, the district administration has invoked prohibitory orders under Section 144 of the CrPC and
provisions of the Disaster Management Act, directing the residents of Tower G to vacate their flats within
15 days. Criminal action can be taken against the homeowners if they don’t follow the order.
Tower G is the fourth building at Chintels Paradiso to be declared unsafe for habitation this month. The
announcement was made after experts from IIT-Delhi flagged chloride content in concrete and corroded
steel bars of the building.
