NCDRC directs JMD to refund excess amount charges from buyers
The National Consumer Disputes Redressal Commission (NCDRC) has directed the realty developer JMD to refund excess amount charged towards super area by adding the area of balcony and also ordered to transfer contingency deposit to the RWA with IFMS.
Residential Welfare Association of JMD Gardens, a housing society at sector 33, Gurgaon, had filed a complaint on behalf of its 47 members. JMD builder has further been directed to fix all the project deficiencies (including seepage) and to construct a dispensary and community centre as per the initial approved plan.
The builder now will also have to provide power backup to each flat for 6.5 KVA. Further, the builder has been ordered to refund amount collected as preferential location charges (PLC) to all the homebuyers in L& M block and excess amount charged as EDC to RWA with interest of 9% per annum.“We waited 8 years for this day and hail the NCDRC for rescuing the flat buyers against the builders who do not fulfill their promises. We hope that the JMD builder will comply with the directions given in the judgement within the time frame of 6 months as directed by
the NCDRC,” said Raj Kumar, President of RWA, JMD Garden, Raj Kumar.
According to the complaint, developer had charged a significant amount of money for various facilities and amenities like amphitheater, school, shopping complex among others as ver the conditions of approval for the building plan granted by DTCP, Chandigarh, Haryana. However, these facilities were not provided to the residents.Sunil Bedi, owner of JMD did not respond to text message and call.
